Assassinate does not make you enter combat, so invis does not drop. If you fail the assass and enter combat, it does. The behaviour is fine as is - there are very few places it can really be abusde (partly because every mob and their dog can di anyway, welcome to escalation).

I think making it 1/week is a great idea. The cloak has good enough stats that folk will want to wear it all the time, so it will charge. The proc should exist as a life saver if things go wrong.

Note: this isn't Tiamat EQ :-)
